彩民知情权的界定与保护——由“知情权缺位”引发的思考

摘　　要：长期以来,我国的彩票事业一直得到彩民的积极参与和高度关注,巨奖中出的案例也屡见不鲜,由此显现出的公众知情权与中奖者隐私权的界定与平衡问题也成为讨论的焦点。购彩行为中知情权的内涵需要进行准确的界定,从而才能更好地明确彩民知情权可保障的范围。通过对我国彩票事业的现有监管体制、信息公开机制等方面存在的缺陷进行分析,提出应从完善监管机制、增加信息公开度等方面着手,重构知情权的保护机制,给予彩票事业一个阳光透明的环境。Lottery has long received great participation and attention from our people. It is common to see someone became wealthy instantly due to the lottery he bought. The conflict between the protection of one's privacy and others' right to know became our greatest concern. This article starts with specifying the meaning and scope public's right to know,then analyzes the defects existing in our current regulation system and the public mechanism of government information. We shall perfect the current mechanism and make more relevant information known to the public,so that public's right to know may be well protected and a healthy environment for lottery will be provided.
