摘 要:国土资源部公开征求意见的《中华人民共和国土地管理法(修正案)》(征求意见稿)对农村土地制度改革"三项试点"积累的可复制、可推广经验做出了充分回应,其对集体经营性建设用地入市的规定消除了集体经营性建设用地入市的法律障碍,同时对入市的前提条件、主体、方式、范围、授权国务院另行制定的事项等做出了原则性规定。这些规定对于建立城乡统一的建设用地市场意义重大,也体现了此次改革"稳中求进"的特色。这一改革举措解并不意味着"集体土地上可以开发房地产"或"小产权房"可以"转正"。Ministry of Land and Resources has released an amendment to "PRC Law on Land Management” for public comments (hereinafter referred to as this Law). This Law responds adequately to the replicable and propagable experiences that have been building up from the pilot projects for reforming rural land acquisition, proftable collective constructive land entering market, and the rural homestead system. The regulations as stipulated in this Law provide legislative guarantee for proftable collective constructive land entering market. At the same time, the issues concerning prerequisites, entity, ways, and scope of entering market, as well as the affairs that must be authorized State Council to formulate separately, the principal provisions are made in this Law. All these provisions will not only have important implications for establishing the unifed construction land market of urban and rural, but also represent the reform features of making progress while maintaining stability. In the end, this paper points out emphatically that this reform measure does not mean that building houses on rural collectively owned lands are allowed, or, the houses with limited property rights can be legalized.
