摘  要:竞技足球运动具有天然的国际性,作为涉外民事关系的一部分,球员和俱乐部之间的涉外足球劳动合同同样属于国际私法的调整范围。然而,区别于普通的涉外民事关系,涉外足球劳动合同争议中的国际私法问题的处理存在特殊性。就涉外足球劳动合同争议的涉外因素而言,由于足球领域的国是指构成国际足联成员的各足协管辖的区域,实践中更关注隶属于不同足协的俱乐部之间的转会以及球员的体育国籍;就涉外足球劳动合同争议的管辖权确立而言,尽管理论上国际足联争端解决委员会基于当事人的约定有权受理此类案件,没有否定法院管辖的可能,但在实践中除非存在排他性的选择法院协议,否则其不欢迎司法介入;就涉外足球劳动合同争议的法律适用而言,为了实现劳动合同的稳定性,争议解决主要适用国际足联制定的统一规则,传统国际私法中的冲突规范指引准据法的作用有限;就涉外足球劳动合同争议所作裁决的承认与执行而言,由于国际足联采用自执行的方式,无论其争端解决委员会还是扮演上诉机构角色的国际体育仲裁院作出的裁决一般不会寻求法院的协助。此种作法往往被视为社团自主的范畴,从而多免于遭受司法审查。Athletic football has an interuational nature. As a part of foreign-related civil relationship, the disputes on foreign-related football labor contractsbetween players and clubs belong to the adjustment range of private international law. However, different with ordinary foreign-related civil relationship, the is-sues of private international law in disputes on foreign-related football labor contracts have distinctive natures. On the foreign-related elements, because the' nations' in the field of football is the territories of football associations, which are the members of FIFA, it is more concerned about the transfer between theclubs belonging to different football associations and the player's sportive nationality in the practice. On the establishment of jurisdiction, although the DisputeResolution Chamber of FIFA is entitled to hear such cases of international dimension according to the agreement of parties in theory, it does not prejudice thecourt to exercise jurisdiction over such disputes. However, unless there is an exclusive choice of court agreement in the practice, it does not welcome judicialintervention. On the application of law, to achieve the stability of labor contracts, its dispute resolution mainly depends on united rules of FIFA Regulation, sothe role of reference of applicable law by conflict rules in the traditional private international law is limited. On the recognition and enforcement of awards, be-cause the FIFA adopts a self-implementation system, either the awards of Dispute Resolution Chamber or Court of Arbitration for Sports that plays a role of ap-pellate body generally do not need to seek an assistance of the court. Such practices are often regarded as a reflection of community autonomy, and to avoid be-ing subject to judicial review.
