摘 要:船员外派机构法律定位之确立是规范船员外派管理,维护外派船员合法权益的重要问题之一。在厘清学界对船员外派机构法律地位所形成的"中介说""用人主体说"以及"折衷说"三个理论的基础上,分析其不确定性所带来的相应困境及原因。借鉴域外国家的相关立法规范,提出"协商折衷说"理论,确定船员外派机构法律地位要以充分的协商为前提,并在《中华人民共和国海员外派管理规定》中规定外派船员获得相应的咨询及建议的权利。The demarcation of the crew assignment is to regulate the current crew export management system and protect the crew’s interests. When learning the three theories which are agent theory, employer theory and agent or employer theory re-spectively, we should analyze the difficulty in defining the crew assignment and its reason. After learning the regulation from the other countries, the negotiation theory will be promised. It is assumed that sufficient negotiation is required when defining the legal status of the crew assignment institution and that the crew should have the right of consulting and receiving the ad-vice under the Provisions of the Peopley s Republic of China on the Administration of Overseas Assignment of Seamen.
