摘　　要：海事案件由海事法院专门管辖,适用《中华人民共和国海事诉讼特别程序法》《中华人民共和国海商法》等特别法;破产案件由地方人民法院受理,主要适用《中华人民共和国企业破产法》。海事诉讼与破产程序分头并行,冲突与矛盾不断困扰司法实务。以亲历的案件实例为基础,疏理归纳二者在管辖、审判、保全与执行、清偿四个方面的冲突,研究二者之间在上述四个方面的程序衔接,并提出完善立法、及时制定司法解释建议和方案。Maritime courts have exclusive jurisdiction over maritime cases which are tried by Special Maritime Procedure Law of the People’s Republic of China and Maritime Code of the People’s Republic of China. Bankruptcy cases are under jurisdic-tion of local courts, while Enterprise Bankruptcy Law of the Peopley s Republic of China is applied. The separation of maritime litigation and bankruptcy procedure causes a lot of conflicts and contradictions in judicial practice. Based on cases accepted and tried by maritime courts, the article enumerates on the four conflicts namely jurisdiction, trial, attachment and enforce-ment, and settlement of the above two procedures, studies the procedure connection of the four conflicts and proposes some suggestions for improving legislation and enacting judicial explanation.
