摘　　要：当前学术界对活体器官捐献研究较多,而对无效活体器官移植研究较少。鉴此,本文从民法角度分析"无效活体器官移植"概念及其特征,阐述活体器官移植所存在的诸如供体资格不合法、意思表示不真实、器官捐献内容违反效力性强制规定等无效情形,进而提出禁止类推适用返还请求权、民事损害赔偿救济等建议,以加强对受体和供体的保护。There is more research on living organ donation in the current academic community, and less research on ineffectual living organ transplantation. Therefore, from the perspective of civil law, this paper analyzes the definition and characteristics of invalid living organ transplantation, and explains the invalid situations in invalid living organ transplantation, such as illegal qualification of the donors, intention misrepresentation, and the contents of organ donation are in violation of the validity of the compulsory regulations, etc.. On the basis of this, it is proposed that the application of the extension of the right of return claim be forbidden, and civil damages be compensated, etc., so as to strengthen the protection for the acceptors and the donors.
