摘 要:网络直播政府规制是网络空间治理的重要内容。本文基于博弈论的视角,分析了政府部门与网络表演者、网络表演经营单位间的博弈关系,结果表明:政府部门的处罚力度、监管成本以及违规表演的发现概率是博弈模型中的关键因素。为了有效降低网络表演者、网络表演经营单位违规行为的概率,政府部门应实行网络信息服务实名制,实施严格的处罚制度;建立综合防御机制,降低政府部门规制成本;借助社会力量,提高违规直播的发现概率。The regulation of Internet live broadcasting is the important content of cyber space governance.The legal regu- lation of internet live broadcasting in China has experienced two stages from source to development.Based on the per- spective of game theory ,this paper analyzes the game relationship between government departments and network perform- ers and network performance management units.The results show that the penalties,regulatory costs and probability of discovery are the key factors in the game model.In order to effectively reduce the network performers,network perfor- mance units of the probability of irregularities ,there are three measures:First,improve the real-name information network service system,the implementation of strict penalties system;Second,the establishment of an integrated defense mecha- nism to reduce government regulation Cost;third is the use of social forces,to improve the wide range of illegal broad- cast probability of discovery.
