马锡五审判方式对数字时代司法的价值

摘　　要：数字时代为司法带来了新机遇,但源于技术自身的经济逻辑,信息科技无处不在的弥漫与浸渗,也给司法职业带来了挑战。由于信息化本身之限度,加之中西方经济、文化、教育存在的差距,司法信息化虽有助于但却不全部适合现阶段中国的具体现实,亦不能完全达致公正、高效等司法价值目标。马锡五审判方式代表着新民主主义司法的优良传统,回望马锡五时代优良司法传统中的司法温暖、司法智慧、司法为民等价值和理念,这段红色时光中的司法故事依然感动着我们。因此,应将马锡五审判方式中的优良司法传统吸纳进数字司法,将这一司法智慧与科技优势相结合,构建中国司法特有的智慧和富有温度的信息化司法。The digital age,with the help of information technology,justice has benefited from the new technology.On the economic logic of technology itself,the pervasive information technology is everywhere,judicial profession confront both opportunity and challenge.But due to the limit of information itself,the gap between the Midwest economy,culture,educa- tion,legal information may help but are not necessarily suitable for China＇s concrete reality,cannot fully achieve fair,ef- ficient,such as value target. Ma Xiwu＇s trial way represents a new-democratic judicial tradition of excellcnce,a piece of Red time of justice story still move us.Judicial wisdom and the advantage of science.with the help of information tech- nology,constructs China＇s judicial person unique wisdom and rich temperature information justice.
