论行政给付中的国家辅助性原则

摘　　要：我国行政给付水平的提升是在经济快速增长的前提下实现的,目前教育、科技、医疗等各种行政给付水平提升较快,各种补贴项目更是令人眼花缭乱。本文通过对国家辅助性原则在行政给付中的具体运用进行梳理,尝试提出国家辅助性原则在我国行政给付中如何落实的建议。With the improvement of China＇s economic level,in the medical,education,minimum living security and other administrative levels continue to improve ,various subsidies are dazzling everywhere.Although there are a large number of administrative laws and regulations,but there are still a lot of problems need to be solved in reality,principle of sub- sidiary scholars advocated the introduction of extraterritorial in payment administration,also some scholars advocated the principle of legislation in our country have already entered the country ,the principle of subsidiary legislation of adminis- trative law in China,but for the principle of subsidiary meaning and essence of research is not clear,in this paper,by analyzing the specific application of principle of subsidiary in administrative supply,try to put forward the principle of how to implement the national assistance in our country in the administrative payment advice.
