摘　　要：近年来,有效控制规则被国际司法机构广泛应用到领土主权争端案件中,而这些实践也进一步丰富和发展了这一规则的内涵。有效控制规则的判定标准主要有两项,即"主权者行动意愿"和"权利的实际行使或显示"。有效控制规则的运用存在一定制约条件。现今南海部分国家采取多种行为以期适用有效控制规则解决岛礁主权争端,面对南海岛礁争端情势的日趋严峻,我国应该采取措施积极应对。Recently, effective control has become one of the most important rules in solving territorial disputes by the International Court of Justice. These practices are also further enriched and developed the con- notation of the rule. Effective control has two criterions like sovereign＇ s actions right. This rule is also limited by a series of existing rules of international law. states in the South China Sea take various actions to solve the islands sovereignty Our country should take measoures to actively respond to these actions. and the actual exercises of Nowadays, some neighboring dispute by effective control.Our country should take measoures to actively respond to these actions.
