摘　　要：贪腐资产的境外转移是贪腐分子隐匿犯罪所得和逃避本国法律追究的重要途径。本文研究跨境追赃法律问题,分析了我国跨境追赃所面临的困境包括法律缺失和配套制度的不够完善,提出了完善跨境追赃法律体制的路径,包括跨境追赃的法律体系和相关配套制度的构建,为我国司法机关在实际追缴境外资产的过程中提供理论基础,有助于在实践中更好地发挥其职能。Transferring cornlption assets overseas has become a significant means for corruption officials to hide what they obtain illegally and avoid prosecution by the national law. This topic studies the legal issues of recovering assets overseas, and analyzes the dilemma China faces in cross-border booty recovery, including legal insufficiency and imperfection of affiliated mechanisms. The approaches to complete the legal framework of cross-border booty recovery are brought up, which include the formulation of a legal system of recovering stolen assets overseas and relevant affiliated mechanisms. They provide theoretical foundation for judicial authorities and administrative agencies on the process of recovering assets overseas, and help them to better function in practice.
