论德国特殊侦查措施对我国立法和实践的启示

摘　　要：2012年《刑事诉讼法》的修正将特殊侦查措施纳入了刑事诉讼法的规制,这是促使刑事侦查程序法治化的重要标志之一。特殊侦查措施因其在技术运用或实施方式上的特殊性,往往涉及到公民隐私权保护以及其他人权保护问题。不可否认,目前《刑事诉讼法》关于特殊侦查措施的规定仍然存在不完善、不科学之处。大陆法系的代表国家德国在其刑事诉讼法典中对特殊侦查措施进行了详尽的规定,在主体、适用范围、具体类型等方面对我国特殊侦查措施的完善具有重要的借鉴意义。The revision of ＂the Code of Criminal Procedure＂ in 2012 incorporated special investigation measures into the regulation of the criminal procedure, which is one of the important symbols to promote the rule of law in crimi- nal investigation. Special investigation measures are often related to the protection of citizens＂ privacy and other hu- man rights because of their particularity in the application or implementation of technology. It is undeniable that the current provisions of ＂the Code of Criminal Procedure＂ on special investigation measures are still imperfect and unscientific. As the representative of the civil law system, Germany regulates the special investigation measures in detail in its Code of Criminal Procedure, and it provides the reference for China to improve the special investigation measures in the subject, the scope of application and the specific types.
