摘　　要：2015年我国全面两孩政策出台后,山东省制定修订出台了一系列法规政策,为全面两孩政策的实施提供了保障。当前,山东省女职工的健康、休假、经济、医疗、就业等待遇得到基本保障,但生育保障制度建设也存在着如下问题:相关法律法规政策滞后,法律法规落实不到位;隐形性别歧视现象加重,二次生育对女性就业、职业发展影响较大;社会保障机构设施不健全,公共服务资源严重不足;生育保险制度尚不健全,生育保障作用没有得到充分发挥。为此,必须健全完善生育保障相关法律法规政策,为全面两孩政策的实施提供强有力的法制保障;健全完善生育保险制度,切实增强其生育保障能力;充分认识女性生育社会价值,切实发挥政府在生育保障中的作用;加强监督检查,促进有关法规政策的全面落实;立足工会职能,切实维护女职工生育权益。After the overall two-child policy was approved in 2015, Shandong province made, revised and released a series of regulation and policies which provided local security for the implementation of this policy. At present, female worker’s legal rights and basic security in aspects of their health, vacation, economy, medical treatment and employment have been protected. However, there are still some shortages as followings： first, relative regulation and laws are not advanced enough, so the implementation does not reach designed position; second, the phenomenon of invisible gender discrimination is growing. Second fertility severely affects female worker’s employment and career development; third, social security facilities are not sound and public service resource is seriously inadequate; fourth, maternity insurance system is imperfect, therefore, the function of maternity security cannot be fully displayed. Therefore, according to these problems, government must carry out the following countermeasures： perfect relative regulation and laws in maternity security and provide powerful legal protection for implementation of overall two-child policy; perfect maternity insurance system and increase its maternity protection capacity; fully recognize social value of female maternity and show government’s role in maternity security; strengthen supervision and inspection, promote comprehensive implementation of relative regulation and laws; base on the function of trade unions and effectively protect female worker’s reproductive rights.
