现代大学制度视角下的政府举办者权义章程规制完善

摘　　要：强化高校章程对政府举办者权义的规制,对促进良性互动政校关系建立,推进高校办学自主权落实与扩大,加快中国特色现代大学制度建设十分重要。现代大学制度建设与政府举办者权义章程规制有着内在的互动关系。从章程文本实证分析来看,虽然部分公立高校章程对政府举办者权义关系规制,但规制普遍存在行政化倾向明显、权利义务内容不完整、争议解决机制缺位、法律责任机制缺失等问题。我国公立高校章程应以促进现代大学制度建设为基本目标,采取有效对策完善文本规定,以完善政府举办者权义章程规制,夯实和谐政校关系建设制度保障,推进现代大学制度建设。Strengthening constitution regulation of government organizers＇fights and obligations is of great importance to promote the construction of harmonious relationship between government and universities, the implementation and expansion of universities＇ autonomous fight and accelerate the construction of modem university system with Chinese characteristics. There exists an inner interaction between the establishment of modem university system and the constitution regulation of government organizers＇ rights and obligations. From the empirical analysis of the text, some public universities＇ constitution have regulated the relationship of rights and obligations for the government organizers, but there still exists some common problems such as the obvious tendency of the administerization, the incomplete contents of the rights and obligations, the absence of the dispute settlement mechanism, and the lack of legal responsibility mechanism and so on. The constitution regulation of the public universities in our country should take promoting the construction of modern university system as the basic target, and adopt effective countermeasures to perfect the text to improve the constitution regulation of the government organizers＇ rights and obligations, strengthen the institutional guarantee for the construction of harmonious relationship between government and universities and promote the construction of modern university system.
