城市土地经营中的廉政风险研究——基于土地权利关系的视角

摘　　要：城市土地经营是近年我国地方政府发展经济过程中重要的策略选择,但是由于城市土地具有稀缺性、垄断性的特点,土地经营伴随着较高的廉政风险。本文选择土地规划权、土地使用权、土地收益权与土地抵押权,通过分析公权力与四种权利类型的关系,揭示城市土地经营不同策略下,地方政府涉土领域的廉政风险根源。研究表明:在土地出让的经营策略下,土地规划权中公权力膨胀、土地使用权行使中"审批"特征突出,使得规划权与使用权的行使伴随着较高廉政风险;而收益权与抵押权的行使对公权力形成了制约,廉政风险相对较低;在第三区域建设的策略下,土地受公权力的高度集权控制,同时地方政府在土地管理体制、决策权等方面赋予较多自由裁量权,导致规划权、使用权、收益权和抵押权的行使伴随高廉政风险。Recent years we saw Chinese local governments taking up ＂urban land administration＂ as a strategically crucial policy while developing local economy. However, the administration goes with relatively high corruption risk in land management. This essay aims at revealing the roots of the aforementioned high corruption risk by analyzing two primary land-administration policies, ＂Land Transfer＂ and ＂Third Area Construction＂, with a deep insight into the relationship between ＂Public Power＂ and four ＂Right Patterns＂. The research shows： whereas the exercise of land planning right in which public power tends to swell and that of land use right in which ＂Administrative Approve＂ stands out as a prominent character bear relatively higher corruption risk, nevertheless exercise of land proceeds right and that of land mortgage right, forming a restriction upon public power, go with relatively lower corruption risk. In the empirical strategy of Third Area Construction, land is controlled by highly-centralized public power and local governments, in the mean time, are entitled to more discretionary power with of land planning right, corruption risk. regard to land-management system and decision-making power etc., so that exercises land use right, land proceeds right, and land mortgage right are going with high
