法律思维下的合理怀疑之基本问题探讨——基于对《“法”的故事》的思考

摘　　要：苏力在《"法"的故事》一文中基于合理怀疑,对许慎或者说近代法理学家关于"法"的概念的解说进行了论证,并提出了自己的见解。《"法"的故事》中所体现的合理怀疑,其实是一种法律思维。合理怀疑有助于解决法律的立法、执法。但在目前,合理怀疑在实践中并不被重视,因此通过明确合理怀疑在法律上的作用,探讨合理怀疑的含义、存在依据和如何运用合理怀疑,有利于推进合理怀疑在实践中的发展。Su li in the story of “law”, basing on the reasonable doubt, discussed and put forward his opinion of the concept of law proposed by Xu Shen or the modern Jurists. Reasonable doubt, reflected in “The Story of Law”, actually is a kind of legal thinking. It will contribute to resolve the problems of legislation, law enforcement and justice in law. But at present, it can’t get enough notice in practice. Therefore, it is helpful to promote its development in practice by clarifying its function in law, discussing its meaning and existence basis and learning its application.
