摘 要:地震预警涉及地震预警信息检测及处理、信息发布和传播、信息利用等诸多环节,具有技术和社会双重属性,具有较强的社会效能。为发挥地震预警的减灾实效,地震预警各个环节工作必须依法有序有效地开展。目前我国正处于地震预警法律制度建设阶段,在此背景下对立法中涉及到的几个主要问题进行了探索性分析。首先分析了地震预警信息发布主体,其次就规范地震预警信息发布和传播行为进行较为详尽的论述,最后针对地震预警信息发布中的误报和漏报问题进行了探讨。Earthquake Early Warning System (EEWS) includes many links, such as information detection and pro- cessing, information release and dissemination, use of information etc. It has technical and social dual attributes, and it can play a strong positive effect on society. In order to achieve its effects, all links must work orderly and ef- ficiently according to law. At present, China is in the legal system construction phase on EEWS. This article makes a exploratory analysis on several major issues involved in legislation. First, it conducts a detailed analysis of infor- mation release body. Second, it discusses earthquake early warning information release and dissemination behaviors in detail. Finally, this article has a discussion about wrong information and missing information during the informa- tion dissemination process.
