权色交易的刑法规制问题思考

摘　　要：权色交易发案率高,诱惑性、腐蚀性强,社会危害性重,但因调查取证难、不经济、不好认定等因素,一直被反对入罪。权色交易入罪,谴责的是因满足性需求而带来的公权力的滥用,而非对性提供者自愿性行为的刑法评价,建议增设性受贿罪和性行贿罪来规制。国家工作人员利用职务上的便利,威胁、要挟他人提供性服务,为他人谋取利益的,或者接受他人提供的性服务,为他人谋取不正当利益的是性受贿罪。为谋取不正当利益而向国家工作人员提供性服务的,成立性行贿罪。因其量刑情节的认定需要法官更大的自由裁量权,因此,建议其法定刑可以参照受贿罪和行贿罪的,并适当偏低。当行为人的权色交易构成犯罪,同时又构成其他犯罪的,数罪并罚,能更好地起到一般预防的效果。With strong temptation and destruction, there is high crime rate in power-sex deal. It hasn't been categorized into criminal system for the difficult identification and evidence collection. Identifying power-sex deal as illegal means the punishment for those who misuse authority for sexual requirement, but people who willingly provide sexual services are excerpted from this punishment. Both bribery crime and corruption crime related to sex should be recognized as illegal. Civil servants who accept or threaten others to provide sexual services should be sentenced into sex corruption crime. People who provide sexual services for civil servants to get improper profits should be sentenced into sex bribery crime. Judges requires more power to decide the measurement of penalty for crimes related sex. The legal penalty can refer to bribery and corruption crime, but be lower than them. If a person has power-sex crime and other crimes, combined punishment for all crimes can get better alert effective.
