摘　　要：2014年6月6日,国务院法制办发布了《中华人民共和国著作权法(修订草案送审稿)》,图书馆界的建议在其中未能得以体现。技术措施作为独立于传统著作权体系的新制度,对其保护应当受到一定的限制,否则,著作权人利益与促进作品传播政策将失衡。美国《数字千年版权法案》(DMCA)最早规定了禁止规避技术措施例外制度,包括法定一般例外和授权国会图书馆每3年颁布的临时例外。特别是国会图书馆临时例外制度适应了技术发展,为完善我国图书馆禁止规避技术措施例外制度提供了借鉴。The Copyright Law of the People＇s Republic of China （Draft） was issued on June 6th, 2014 by the State Council of China. However, libraries＇ suggestions were not reflected in the draft. Control technologies, although independent from the traditional copyright system, are an integral part in balancing the interests of copyright owners and the communication policy of promoting works, DMCA adopted in the USA prescribed exemption to prohibition of circumvention of control technologies, which defined terms of general exemptions and temporary exemptions issued on a three-year basis by the Library of Congress, which could be used as a reference for perfecting the exemption to the prohibition of circumvention of control technology for our country libraries.
