《人民警察法》是我国警察法体系的基本法——关于《人民警察法(修订草案稿)》的几点认识

摘　　要：我国《人民警察法》应当成为我国警察法体系中,统一规范各种体制警察组织的职权、综合适用的基本法。它规定着我国警察权的基本类型,包括第一层次的公共安全管理权与警察刑事执行权,第二层次的治安管理权、道路交通管理、消防、出入境等公共安全管理权和刑事调查、刑事侦查、刑罚执行等刑事执法权,规范各种警察行为、措施、方法等职权表现形式;警察组织是警察权的基础,只有规范了警察组织才能设定警察权;警察权与警察职能通过警务活动来实现;《人民警察法》贯穿着履行警察职能、执行警察职务的核心内容。In China＇ s police law system The People ＇ s Republic of China People＇ s Police Law should be the comprehensively applicable basic law that keeps all police organizations of various organizational structures in unifi- cation and standardization. People＇ s police law, stipulating the basic police powers and powers performance in as- sorted police acts, management and approaches, consists of two levels police powers, public security management power and criminal implementation power of police at the first level; other public security management powers in- eluding public order management, highway traffic management, fire service, exit -entry management and criminal enforcement powers including criminal investigation and penalty execution at the second level; public organization is the fundament of police power that can be established only after the normalization of the former; police powers and police functions are achieved in conducting police activities ; people＇ s police law bring the essential parts of fulfil- ling police function and implementing police power together.
