关于《中华人民共和国人民警察法》修改的几点思考

摘　　要：《警察法》修改是一项关系到国家安全、社会治安秩序的严肃工作。以公安部公布的该法修订草案稿为基础,《警察法》的调整范围应当涵盖所有设有警察的国家机关及其警察;确定警察身份应当根据其人事关系、编制类型和警务特征等进行综合考量;应当对警察职权与非警察职权、警务活动与非警务活动划出明确界限;应当对警察权按照责权相应原则,进行合理配置;应当规定在遵循中央与上级集中统一领导,尊重地方和下级自主权的原则下,实行中央和地方公安机关的法定"职权"分工。The amendment of police law concerns national security and social order and must be given serious considerations. Taking the revised draft of police law published by Ministry of Public Security as the foundation, all the state organs that include police mechanism and policemen must be involved; the policemen identity must be af- firmed after a comprehensive examination of their human relations, the type of manning quotas and characteristics of police acts ; the definition of police powers and police acts must be clarified ; police powers must be reasonably allo- cated in line with the equality of power and responsibility; the division of legal functions and powers of central and local public security organs must be made according to the principle of following the unified leadership of central and higher authorities and respecting the autonomy of local and lower authorities.
