法益视野下低保权利和低保权力的衡平发展——以浙江省农村低保制度为例

摘　　要：近年来,农村低保水平有了很大提高,但村民的怨愤情绪也同比上升,其根源在于低保制度推进过程中的单一行政命令模式和对低保权利的保障不足。因此,要促使农村低保制度由权力本位向权利本位转型;保障和加强民众低保权利,动员社会力量积极参与,以形成对低保权力的有效制约;促使低保立法由传统的命令管制法向现代利益衡平法转型,明晰管理机构的低保权力,求得低保权利和低保权力的衡平发展,以提高民众的满意度,促进农村低保制度健康发展。Minimum Living Security （MLS） system has developed quite well in recent years, while people＇ s resentment mood has been rising with the standard of MLS in rural area at thesame proportion. This paradox roots in the problems that the development of Chinese MLS system in rural area depending on the model of monogamous administration order and the lack of the protection of peasant＇s right of MLS. The orientation of MLS law should be switched from power center to fight center. People＇ s fight on MLS should be protected effectively, and social forces should be mobilized to participate actively, so that the administration power of MLS will be restrained. The model of MLS law should go ahead with modern interest-balance law from traditional governing law. It is indispensable to make regulator＇s power explicit, and to pursue the balance development between the right and the power of MLS in order to achieve people＇ s satisfaction and nudge MLS system to develop healthily.
