司法改革视阈下人民陪审员参审范围的改革与重塑

摘　　要：为了进一步体现司法民主,本轮司法改革扩大了人民陪审员的参审范围。参审范围的总括性规定较为广泛,力图扩大陪审员参审范围;原则上参审类案件的文本表达尚且模糊,并且遗漏了死刑案件;当事人申请参审类案件的裁量权在于法院。应当在平衡司法民主与司法效率的基础上,基于陪审必要性考量将参审范围限于重大复杂案件;具体区分为原则上适用人民陪审员参审案件和被告人选择是否启用人民陪审员参审案件两大类;并且应当明确审判组织构成不合法的程序性后果。In order to further reflect the judicial democracy, the current round of judicial reform has expanded the scope of people＇ s assessors＇ participating trial The general provisions of the scope of people＇s assessors＇ participating trial is wide, the purpose of which is to try to expand the scope. The text definition of the scope of people＇s assessors＇ participating trial in principle was fuzzy, and the death penalty cases have been omitted. The decision of whether the case is participated by people＇s assessors is made by the court. Based on the balance of judicial democracy and judicial efficiency, the scope of people＇ s assessors＇ participating trial should be confined to major and complex cases. People＇s assessors＇ participating trial cases can be divided into two types. One is applying people＇s assessors＇ participating trial cases in principle, the other is applying people＇s assessors＇ participating trial cases according to the defendant＇s choice. Procedural consequences should be produced to the defendants if trial organizations are illegal.
