网络恐怖活动的法律漏洞问题研究

摘　　要：随着全球化的发展,信息全球化的影响也越来越大,在这种背景下的网络恐怖活动也具有全球化的特点,其影响力更广、破坏力更强,使之成为一种综合形式的恐怖活动类型。为了更加有效集中地打击恐怖活动犯罪,我国不断推进反恐立法的进程,目前已经基本形成了相对完善的法律保障体系。但是,目前我国关于网络暴恐活动犯罪的刑事立法并非十分完备,还需要进行完善。本文通过分析立法漏洞,为有效打击和预防网络恐怖活动犯罪提供改革途径的新思路。With the development of globalization, the influence of globalization information is becoming more and more serious. In this context, cyber terrorist activities are also characterized by globalization, and their influence is more extensive and destructive, which make an integrated form of terrorist activity. In order to more effectively focus on the fight against terrorist activities, China has continuously advanced the process of anti-terrorism legislation, has basically formed a relatively perfect legal protection system.However, at present, China＇s criminal legislation on cybercrime activities is not very complete, there are some loopholes need to be improved. This paper analyzes the legislative loopholes, to effectively combat and prevent cyber terrorist activities and to provide a new way of reform.
