摘　　要：全面提升专利质量是我国当前专利工作的重中之重,文章通过专利无效、复审程序中的几个典型案例,尝试剖析从技术向专利转化环节存在的导致创新不能得到应有保护的高发问题,并基于当前我国专利制度框架下,提出几点建议,以期一项具备创新性的技术得到其应有的保护。To enhance the quality of patents is the priority among priorities of China＇s current patent work. By means of typical cases of patent invalidation and reexamination, this paper tries to analyze the questions which lead to innovation cannot be protected from the transformation of technology to patent. And based on the China＇s patent system, put forward some suggestions in order to an innovative technology to get its due protection.
