检察官办案责任制改革及其运行困境研究

摘　　要：以"员额制"为特点的检察官办案责任制改革,是目前检察改革中最重要的任务之一。检察官办案责任制旨在强化检察官的办案职权,确保办案检察官对案件有权依法独立审查、判断并做出决定,同时对自己的决定承担全部法律责任。通过对S省C市、H省W市等地有关检察院的实证调查发现,以"员额制"为核心的办案责任制改革,在减少办案审批流程、突出检察官办案主体地位、提高办案效率等方面确实产生了积极的影响;但由于改革时间尚短,在办案质量上的影响暂时还无法得出明确的结论。Reform of responsibility system of inquisitors handling cases is one of the most important tasks in procuratorial reform which is characterized by ＂system of specified-number-of-judge＂. The purpose of responsibility system of inquisitors handling cases is to strengthen the handling authority of inquisitors, and to ensure that inquisitors have the rights to review, judge and make decisions on the cases in accordance with the laws, while taking full legal responsibility for their decisions. Through the empirical investigation of relevant procuratorates in C City, S Province.W city, H Province, the author finds that handling cases responsibility system reform, taking ＂system of specified-number-of-judge＂ as its core, has positive impacts on reduction of handling approval process.highlighting dominant roles of inquisitors handling the cases and improvement of efficiency of handling cases. However, due to the short period of reform, the impacts on the quality of handling cases have not yet been able to draw a clear conclusion.
