摘  要:考察"机动车载软件诊断、修理或合法改装"条款,旨在透析美国禁止规避技术措施例外制度如何衡平车企和车主间的利益冲突。分析各利益方围绕非侵权性使用(合理使用与DMCA§117)、不利影响和法定因素三大焦点展开的博弈后,解读该条款的假定、行为模式和法律后果,可知不被视为版权法上的侵权应同时符合:规避主体只能是获准的机动车主,且排除任何第三方主体代为或辅助其实施规避;规避行为须是机动车诊断、修理或合法改装的必要步骤,且规避对象须为控制机动车运转的车载软件;不违反现行法律规范。该条款体现了以产品功能确立豁免边界的新思路,也彰显了适用有较大争议的临时例外的谦抑性。The study of the legislation of diagnosis,repair or lawful modification of a motorized land vehicle onboard software attempts to illustrate how the United States Exemptions to Prohibition on Circumvention of Technological Measures balances the interest conflict between vehicle enterprises and vehicle owners.After analyzing the games between interested parties focusing on non-infringing use(fair use and Section 117),adverse effects and statutory factors,and interpreting the assumption,behavior patterns and legal consequences of this provision,it is found out that such diagnosis,repair or lawful modification are not regarded as the infringement of copyright law if the subject is the authorized vehicle owner,ruling out any third party on behalf of or assisting the owner to circumvent,the circumvention is a necessary step and the object must be the computer software;the circumvention does not violate any applicable laws.The new provision is expressive of the new idea of setting the exemption boundaries with product function,and indicates the modesty of the application of temporary exceptions with controversy.
