摘　　要：互联网技术的变革催生了网络视频行业的蓬勃发展并逐步趋向正版化,但同时也为部分视频网站的"盗链行为"提供了物质基础。设链视频网站通过技术破解措施盗取被链视频网站(正版视频网站)影视资源在自己网站进行无跳转式的直接播放,此类行为极大地损害了被链网站以及著作权人的合法权益,更是破坏了公平有序的市场秩序。但司法裁判却很难根据现行著作权制度与规则规制盗链行为。事实上,可以从一般侵权法体系的侵权四要素角度考量,将盗链行为列入著作权侵权范畴。The changing o f internet technology facilitates the developm ent o f online video industry, but provide thematerial basis to some online video websites on hotlinking behavior. The linking video website pirates the genuine videow ebsite＇s resources and plays them directly on its own web through the tech breaking method. This kind o f behavior hasinfringed the legal rights o f both genuine video websites and copyright holders, and moreover has broken the fairness anddiscipline o f the market order. Based on the current copyright laws and regulations, it is quite difficult to rule and regulate thehotlinking behavior in judicial practice. In fact, such hotlinking behavior can be ruled as copyright infringement through thefour elements o f tort law system.
