摘 要:随着我国经济的高速发展,由出租车打车软件催生的网约车市场日益兴起。在方便公众出行、降低营运成本的同时,也带来价格秩序混乱、安全隐患增多等问题。网约车监管问题的关键在于合理定位政府角色。当前我国网约车监管中政府角色存在着越位、缺位和错位,这和政府与市场关系的扭曲、政府监管的相关法律规范缺失以及政府部门自身的逐利性密切相关。政府在网约车监管中不仅应充当市场竞争的引导者,更应成为市场运行的监管者和市场秩序的维护者。在此基础上,应从优化网约车的市场竞争环境,明确政府网约车监管职能的内容及其边界,加强网约车管理中的法律规范建设,完善网约车的政府监管体系等方面,来促进网约车的监管创新。With the rapid development of China' s economy, internet chauffeured car marketspawned by taxi software is rising. It facilitates public travel and reduces operating costs, but also brings price disor- der, increased security risks and other issues. The key to the problem of internet chauffeured carregulation is a reasonable position onthe role of government. Currently, the role of government in internet chauffeured carregulation is offside, absence and dislocation. This is closely related to the distortion of the relationship between government and market, the lack of relevant laws of government regulation, and the government' s own interests. The government should not only act as the guide of the market competition, but also should become the regulators of market operation and the defenders of market order. On this basis, it is necessary to optimize the market competition environment of internet chauffeured car, explicate the contents and boundaries of regulatory functions of the government, strengthen the legal norms building, and improve the system of government regulation.
