摘 要:对已建封闭住区开放路权,对新建住区采取街区制,实质是促进封闭住区走向开放。本文通过对住区封闭性及其影响因素的表象认识,提出城市土地产权制度是封闭住区走向开放的主要挑战。从理论层面进行了研究,认为封闭住区走向开放的目标是构建"大开放、小封闭"的城市住区格局明晰了城市土地产权制度影响住区封闭性的逻辑,以及封闭住区的适宜规模。实证分析表明城市土地产权合适规模的共有是理想目标。并指出了城市土地产权制度的四个变革趋势与特征,提出了城市土地产权制度现阶段及未来的变革建议。The nature of opening the road-right of the enclosed residential community and adopting block system for the newly-buih residential areas is to encourage the enclosed residential areas to be opened publically. The problem, which the system of urban land property right was a great challenge to be opened publically, was put forwarded after the phenomenon of the enclosure and its effecting factors being studied. The theoretical level of the problem is studied. It is included that the purpose of the opening for an enclosed residential area is to fabric an urban pattern of "More opening and less enclosure" and residential development vitality. Besides, the logic that the urban land property affected the enclosed residential areas and the reasonable scale of the enclosed residential areas is clarified. The empirical analysis is conducted elucidated that it is an ideal objective for common property of urban land property in some proper scale. As for resolving the problem, the four transformation trends and features of the urban land property system are pointed out and the proposal is raised for the present and future reform of urban land property system.
