摘 要:马丁·洛克林提出的功能主义与规范主义的划分,对于分析中国共产党党内法规建设的价值导向与内在逻辑有着重要借鉴意义。在新民主主义革命时期,党中央相对重视党内法规的规制功能与工具价值,通过制定党内法规来解决革命过程中面临的现实问题。这种功能主义导向在社会主义革命与建设时期的特定政治环境中不断强化。"文革"期间,党内法规建设陷入了停滞状态。基于对"文革"惨痛教训的深刻反思,改革开放以来规范主义导向逐步萌芽,党中央更加注重党内法规的限权功能。党的十八大以来规范主义导向进一步强化,促进了党内法规建设的体系化、科学化发展,并推动了依规治党的实践进程。The dichotomy between functionalism and prescriptivism put forward by Martin Loughlin is helpful to analyze the value orientation and inner logic of CPC' s inner-party regulation construction. In the New-democratic Revolution period, CPC emphasized the regulation function and instrumental value, and solved the practical problems confronted during the revolution through formulating inner-party regulations continuously. This kind of functionalism orientation was consolidated during the period of socialism revolution and construction in the special political environment. After the outbreak of the Cultural Revolution, the construction of inner-party regulation fell into a stagnant for a long time. Based on the profound reflection on the painful lessons from the Cultural Revolution, the normative orientation has gradually sprout in the new period after the reform and open-up, and the power-restrict functionality is more valued. After the 18th National Congress of CPC, the prescriptivism orientation got deepened and strengthened, and become the new orientation of the construction of inner-party regulation, and then improved the practice of CPC' s regulation-based governance
