版权的泛社会性特征及其影响研究

摘　　要：版权比专利权、商标权具有更为广泛的社会性的特征。版权具有泛社会性特征意味着版权广泛存在于社会生活领域中,社会生活中的主体皆可能接触、参与版权创造与传播活动。版权法律保护制度的发展必须尊重和落实版权泛社会性特征的要求,版权立法应当保持适当的灵活性和适用性。版权泛社会性特征意味着版权广泛存在于经济发展领域。忽视版权,可能会导致相关产业陷入严重的发展困境;重视和保护版权,则能有效激活版权对相关产业发展的积极作用,促进相关产业转型升级并持久保持活力。Compared with patent right and trademark right, copyright embodies more extensive sociality. This characteristics of extensive sociality of copyright means that copyright exists extensively in various social fields and all social subjects may be related to copyright creation and dissemination. Copyright protection development system must respect and implement the requirements of extensive sociality, and copyright legislation should maintain appropriate flexibility and applicability. The extensive sociality of copyright also means that copyright exists extensively in economic development field. Ignorance of copyright may cause great diffi-culty for copyright industiy development. Copyright protection can well promote its positive effects on the development of relevant industries, upgrade their transformation and maintain their long lasting vitality.Key Words copyright ; extensive sociality ; copyright protection system
