摘 要:全国人民代表大会于2017年3月15日通过民法典总则编,目前考虑编纂物权编等编。本文提出对于民法典物权编通则章的立法建议,希望对于民法典物权编的立法工作能稍尽绵薄之力。第二部分首先分析现行《民法总则》和《物权法》中相关条文对"物权"的定义,探讨现行法对物权的定义是否周延,然后提出物权定义的立法建议;第三部分探讨物权法定或物权自由,比较何者较符合中国特色市场经济的需要,并提出立法建议;第四部分则探讨物权应采行登记生效或登记对抗,比较何者较符合中国特色市场经济的需要,并提出立法建议;第五部分总结全文,提出本文结论。The National People's Congress Passed the book of general principles of the Civil Code on 1 5,March,2017,and is still planning to codify the book of Property and other books.This article submits legislative suggestions to the chapter of general principles of the book of property of the Civil Code.It is hoped that there would be contribution to the legislative task to the book of property of the Civil Code in China.The second part of this article firstly analyzes the definition of property in concerning clauses of the book of general principles of the Civil Code and the Property Act.It explores the appropriateness of the definition of property in current Acts,and proposes legislative suggestion.Part three and part four separately explores the adoption of numerusclusus or freedom of property,and the adoption of registration as validity or effectiveness against.They separately compares two regimes from conforming to the needs of market economy with Chinese characters,and proposes legislative suggestion.Part five is the conclusion.
