摘　　要：运用文献资料法等,梳理中央和省级政府退役运动员安置的政策法规文件,分析了现有政策法规的不足,阐述了出台《退役运动员安置条例》的必要性、可行性及立法原则,构建了以6章近50个条款为脉络的条例框架。研究认为:法治体育是依法治国的重要体现,也是我国竞技体育事业可持续发展的重要保障和必由之路;必须以法的高度保障退役运动员的生存权和劳动就业权,这是国家意志对退役运动员私权利保障的重要体现。Using literature, the article discusses the practical significance of Sports law, reviewing and sorting the policies and regulations for central and provincial governments to replace retired athletes. It analyzes the deficiencies of existing policies and regulations, expounding the necessity to issue the regulations on the introduction of the placement of retired athletes. It witnesses the construction of Chapter 6, in which nearly 50 articles ordinance frame the context. It is concluded that the rule of sports is an important part of the law and sports law is an important guarantee and the important way for the Chinese competitive sports to sustain development. Finally, law must guarantee the highly retired athletes of the right to life , the right of labor and employment. This is an important manifestation of the will of the state to the retired athletes private right protection.
