摘  要:在"一带一路"倡议引起区域内投资争端增长的背景下,充分发挥第三方机构对国际投资争端解决的作用,具有重要意义。目前,"一带一路"沿线国家在签订的双边投资条约中主要选择ICSID为国际投资争端解决机构,导致沿线国家作为被申请人的案件主要由"一带一路"区域外国家的国民处理。因此,为了优化区域内投资争端解决现状、应对区域内不断增长的投资争端、利于地缘性投资保护并推进中国参与乃至引领国际投资规则再构建,有必要创建"一带一路"国际投资争端解决机构。而且在法律、平台和资源方面,创建的可行性也已具备。至于路径,应当借助亚投行的平台制定相应公约,并在ICSID公约基础上创新结构和制度,最后努力推动沿线国家缔结相应公约。Under the background of the increase of regional international investment disputes (IIDs) caused by "Belt and Road (B&R)" initiative, it is significant to make Third Party Settlement for liDs play an important role. However, countries alongside the " B&R" have mostly selected ICSID as IIDs settlement institution in their BITs, which will bring along the result that cases with a "B&R" country as respondent would mainly be handled by nationals of countries outside " B&R" area. Therefore, it is necessary to establish an "B&R" International Investment Disputes Settlement Institution, to optimize the current condition of IIDs settlement in this region, to deal with the continuous rising of regional IIDs, to benefit the protection of geopolitical investments, and to facilitate China to participate in even guide the reconstruction of international investment regulations. Moreover, feasibilities including law, planform and resources have been available for the establishment. With respect to the routes, we should take the Asia Infrastructure Investment Bank as a planform to draft relevant convention, take the ICSID Convention as reference to innovate framework and institutions, and devote great efforts to drive "B&R" countries to contract the relevant convention.
