摘 要:少数民族权利保护的动因缘于道德需要与政治需要,其权利属性的双重性决定了保护方式与实现方式的不同。根据西方政治哲学对平等的实现方式与实质正义和形式正义的探讨,民族平等的实现需要建立在民族差别保护制度的基础上。但在制度设计与实施中,我们却需要将民族身份与民族权利逐步予以剥离,将差别权限定在经济、文化等更具操作性的领域,以避免因集体性保护引发个体权利的分化和虚置,同时还要把握好平等的限度,以免因过度保护引发反向歧视。The reason for the protection of ethnic minorities' rights lie in social needs and political needs, but the dual nature of the right determines the difference in the way of protection and how it is implemented. According to studies on the realization of equality and substantive justice and formal justice in western political philosophy, the realization of ethnic equality should he based on the special protection system of ethnic minorities. But in the design and implementation of the system, we need to gradually strip the national identity from national rights, limit the special fight to more operational areas such as economy and culture, in order to avoid the differentiation and failure of individual rights caused by collective protection. At the same time, we must balance the equality of the limit so as to avoid reverse discrimination caused by excessive protection.
