摘　　要：任何单位或者个人将在中国完成的发明或者实用新型直接向外国申请专利的,应当事先向国务院专利行政部门提出保密审查请求,并详细说明其技术方案。在涉及违反保密审查规定的无效案件中,需要对请求保密审查时提交的技术方案说明书与后来提交的专利申请文件是否一致进行判断。本文对此过程中的技术方案对比方式和对比标准进行了探讨。在广泛研究的基础上提出了三种对比方法及对比标准,为审查实践提供了指导。Any unit or individual that intends to directly apply for patent in a foreign country for an invention or utility model accomplished in China shall submit the request for confidentiality examination to the patent administration department under the State Council, and state the technical solution thereof in detail. In the invalidation case for breach of confidentiality examination, it is necessary to judge the consistence of the description of the technical solution filed at the time of requesting confidentiality examination and the patent application documents filed latterly. The comparison method and standard of the technical solutions during the procedure are discussed. Three comparison methods and three comparison standards are proposed for reference of the examination practice.
