摘 要:《香港基本法》第158条第3款仅对香港终审法院提请全国人大常委会释法的程序做了一般性规定。尽管香港终审法院后来通过四个判例确立了启动提请全国人大常委会释法程序的要件,但在司法实践中相关问题依然存在很多争议和不确定性。根据158条的立法目的,完善提请释法程序的要件必须立足于两个方面:既尊重中央的主权又尊重香港特别行政区的高度自治权,而且在两者并存的情况下尽量使得两者各自得到最大的尊重。本文将基于该立足点,围绕香港终审法院提出的"类别条件"和"有需要条件",进一步从司法技术上探讨适用这两个要件的细节问题。Article 158(3) of Basic Law of Hong Kong stipulates a framework of the preliminary refer ence procedure. Although Hong Kong^s Court of Final Appeal has through four judgments laid down some principles of implementing the reference procedure, the jurisprudence is unclear and pertinent as- pects of the procedure remain undefined. According to the purpose of Article 158, improving the initiating factors of making preliminary reference by CFA should be established on two aspects: a. preserving Chi- na's control over the excluded matters and maintaining judicial autonomy and the integrity of the com mon law system in Hong Kong; b. trying to find out how to balance sovereignty and autonomy. Based on these two aspects, this paper will discuss the application of the classification condition and the necessity condition established by CFA, after which it will propose how to improve the implementation of the preliminary reference system.
