摘 要:2011年康菲溢油事件把要求修改环境保护法的呼吁推向历史新高潮,并成功推动1989年《环境保护法》和1999年《海洋环境保护法》完成修改。但仅仅依靠修改一两部环境法律是否就可以达到有效规制跨国企业污染行为之法律效果,并完成对被侵权者的司法救济之重任,确实还应该再行反思。司法过于行政化、环境司法适用实践匮乏以及缺乏相应系统化启动机制是立法完成后难以有效实施的现实根源。另外,我国司法适用缺乏国际话语权亦是另一重要原因。革除诟病、创新机制并提高国际司法地位应是解决问题之关键。ConocoPhillips' oil leakage that occurred in the year of 2011 pushed the public concern for modification of the environmental protection law to a new level.As a result,the modifications of 1989's Environmental Protection Law and 1999's Ocean Environmental Protection Law were finally completed.However,it is still doubtful that the modifications of one or two environmental protection laws can achieve the expected legal results of pollution-control of trans-national enterprises and provide judicial remedies for the victims.Over bureaucratic judiciary,insufficient environmental judicial application and lack of systematic application mechanism make it difficult to enforce the laws once they are made.In addition,our voice for judicial application is not properly heard internationally.Therefore,it may be concluded that getting rid of bureaucratism,implementing innovative mechanism and upgrading the international status of our judicial application would be crucial for solving the problem of environmental pollution caused by trans-national enterprises in China.
