摘  要:湘西苗族是以寨落为单位聚族而居的,清朝的统治秩序在湘西苗疆确立以前,湘西苗疆的法律秩序是自然形成的。这种法律秩序以寨落为单位,存在两种纠纷解决机制:一是"理老"调解,二是"神明"裁判。两者合法性的来源不同,"理老"调解需要双方当事人的授权,而"神明"裁判则依据双方当事人的"申请",两种纠纷解决机制背后有复杂的逻辑,它们共同维护和奠定了湘西苗族寨落相对稳定的社会秩序。The Miao Nationality in Xiangxi was Living together intheunitsof the villages, the legal order of Xiangxi Miaojiang was a natural formation before the rule of the Qing dynasty has been established in Xiangxi. The legal order includes two kinds of dispute settlement mechanism,the first was "elder mediation",and the other was "Judgment of the god". The legitimacy of the two sources were different, "elder mediation" needed authorizationfrombothparties, "Judgment of the god" based on the judgment of the parties "application".The logic of the two kinds of dispute resolution mechanism that maintained the Social stability of Xiangxi Miao Jiang was complex and profound.
