美国空气污染治理机制的维度构造与制度启示

摘　　要：1970年《清洁空气法》的制定与实施,构成对美国空气污染治理机制的重构:不仅确立了公众健康优先保护的治理理念,而且创建了支撑机制运行的四大维度,即质量标准维度、达标计划维度、诉讼制度维度和制裁保障维度,从而有力地推进了美国的空气污染治理。当前我国正遭遇空气污染之困,可以考虑借鉴美国的相关经验来改进我国的空气污染治理机制。The enactment and enforcement of Clean Air Act of 1970 has fundamentally reconstructed air pollution governance mechanismin the United States. Not only did the mechanism establish governing idea of public health protection primacy, but also constructed four dimensions to support mechanism operation, namely quality standard dimension, standard-achieving program dimension, lawsuit system dimension and sanction guarantee dimension, which effectively promoted the air pollution governance in the United States. Nowadays, China is suffering from air pollution problems, so we may consider drawing lessons from the United States to improve air pollution governance mechanism.
