残障者合理使用作品的理论反思与制度检讨——兼论我国《著作权法》合理使用制度的完善

摘　　要：信息获取是人类的基本人权。残障者在信息获取上处于劣势地位,应提供特别机制以协助其获取信息,著作权法应通过合理使用制度来保障残障者获取作品的利益需求。我国应修改残障者合理使用制度,将"商业性提供"条款纳入其中,同时扩大受益人的范围,限定作品利用主体的范围,增加合理使用作品的类型,扩展合理使用的方式和权限,以满足《马拉喀什条约》的要求和我国残障者事业发展的需要。information acquisition is a basic human right belonging to human beings. The disabled shall be provided with a special mechanism to help them acquire information due to their disadvantages on the access to information. Therefore, their interest demand of works acquisition shall be safeguarded through rational use system by copyright law. We shall modify rational use system, including the ＂commercial offer＂ into it. In addition, we shall enlarge the scope of favoree, define the scope of increase the types of works for rational use, extend the means and limits of authority of rational use requirements of Marrakesh Treaty and China＇ s career development of the disabled.
