摘 要:南京市根据国家和江苏省对排污权交易的相关规定,稳步推进排污权有偿使用和交易工作,已成功实施6次排污权交易,但仍存在没有具体法律依据、监管不严、重复收费、涉及污染物种类少等问题。结合南京市排污权交易实践,针对存在的问题提出了改进建议:加快排污权制度的立法进程;建立统一准确的污染物排放监管机制;对排污权制度和排污费制度进行整合;增加排污权有偿使用与交易涉及的污染物种类;加快南京市排污权交易二级市场的开发利用;对"24561"企业率先实施排污权有偿使用与交易的全覆盖,并加强监管。Nanjing, according to the relevant provisions of the emissions trading of the state and Jiangsu Province, steadily promoted the use of emissions and compensation for the transaction and it has successfully implemented six emissions trading.But there is no specific legal basis and repeated charges, involving less pollutants and other issues. This paper has put forward some suggestions on the existing problems, including: the legislative process of accelerating the system of emission rights, the establishment of unified and accurate pollutant discharge supervision mechanism, the integration of the emission right system and the sewage charges system. The use of pollutants emission and the transaction involving the types of pollutants could promote the development and utilization of the secondary market of emissions trading in Nanjing. And it could monitor and promote the "24561" enterprises to take the lead in the implementation of the use of emissions compensation and the full coverage of the transaction and strengthen supervision.
