排污许可制度下的企业环境责任

摘　　要：排污许可制度是国际上通行的一项环境管理基本制度,是法律对固定污染源的排污行为提出具体排放标准要求并以书面形式确定下来以约束排污者的监管措施。但是,排污企业在获得排污许可证后并不可以任意排污,排污许可制度下企业承担环境责任需要法律的约束与自律并行。在严格遵守法律约束的同时,建立自律机制,尽量减少排污的数量,最大限度地保护生态环境,是企业承担环境责任的前提,是其生产经营活动可持续发展的基础,也是环境正义与环境效率的具体彰显。为此,首先需要企业更新理念,将节能减排、保护环境内化到经营理念之中,以实现自身的可持续发展及社会效益最大化。其次,政府要建立健全环境信息公开制度和企业环境报告制度,加强社会公众对企业承担环境责任情况的了解和监督。再次,政府要做好环境影响评价制度与排污许可制度的有效衔接,在项目规划阶段有效预防,在企业运营阶段有效监管。最后,要加强对企业污染排放的治理,改革排污收费相关制度,在法律法规上健全排污权交易的相关法律制度。The pollutant discharge permit system is the supervision measures which are provided by laws in writing to require the solid pollution sources to comply with specific discharge standards.But this doesn’t mean the enterprises which need to discharge are allowed to discharge at will after getting the license.In the pollutant discharge permit system,the liability of enterprises under environmental lawmust be performed both complying with the lawand also being subject to self-control.A self-control institution must be established,and in the meanwhile the lawmust be complied with strictly.And the amount of pollutant must be reduced,while the ecological environment is protected to capacity.These measures are the preconditions for enterprises to perform their environmental liabilities and the foundation of their sustainable development.The environment justice and efficiency is reflected in this institution.
