摘  要:有关外交领事机构的豁免权与其雇员权利保护的关系长久以来就备受争论,就如同如何平衡国家主权豁免与人权保障问题一样,出现了诸如绝对豁免派和限制豁免派的对立;在外交和领事豁免领域,也经历了由传统的绝对豁免理论走向了职能必要理论的新发展,这突出反映了国际法治大背景下国家主权与人权的博弈,根据国外的司法实践,两者长期对立的发展趋势是人权保护的不断加强和国家主权豁免的自我克制,外交和领事豁免权作为国家主权豁免的派生性权利,其有限豁免也渐进演化为国际法治发展的新趋势,从而使得使领馆雇员的权益保护的司法救济途径变为可能。The relevant foreign consular immunity and its employees has long been a debate about the relationship between rights protection, like how to balance the state sovereign immunity and human rights protection problems, appeared such as absolute immunity of people and restrictive immunity;In the field of diplomatic and consular immunity, also experienced from the traditional theory of the absolute immunity to the new development of the function necessary theory, the prominent reflect the international rule of law, national sovereignty and human rights game under the big background, according to the judicial practice in foreign countries, the two longtime rivals is the development trend of the protection of human rights constantly strengthen the self-restraint and state sovereign immunity, diplomatic and consular immunity as a national sovereign immunity rights, its limited waivers and gradual evolution for the international new trend in the development of the rule of law, protection of the rights and interests of employees so as to make the missions of the judicial relief way possi- ble.
