摘　　要：自《非遗法》实施以来,如"聂麟郊"假药案等非遗事件接连发生,而在"中医药法"尚未施行的现实国情下,《非遗法》则可履行保护、传承与管理中医药类非遗衍生品的责任。《非遗法》不是一部独立的文化行政法,而特定项目的多学科、多部门联合评审,也应将自然科学家及其相关机构纳入评审团队,如此才能保证非遗项目在经验性中凸显科学性,从而在弥补相关法律不足的基础上,避免法与理、法与法的矛盾,进而维系人际关系的和谐,促进社会整体的有序运转。During the implementation of Legislation of Intangible Cultural Heritage(LICH),some ICH events,such as quack medicine of Nie Lin-jiao,have happened in succession.Under the actual national conditions of unimplemented Legislation of Traditional Chinese Medicine(LTCM),LICH can fulfill the responsibility for safeguarding,inheriting and managing the derivatives of TCM ICH.LICH is not an isolated cultural administrative law,but when the specific items are reviewed by multi-disciplinary and multisectoral,natural scientists and their relevant departments should also be included in the review team.So the scientific nature of ICH items can be ensured and highlighted in the experience.On the basis of making up for the inadequacy of related laws,the contradictions between laws and reasons,laws and laws can be avoided.And then,while maintaining interpersonal harmony,the orderly operation of the whole society can be promoted.
