论民族商事习惯的元素特征

摘　　要：民族商事习惯是具有民族特殊性的商事交易习惯,无法改变"习惯"本色,无法改变商事属性,无法改变传统元素特征,依托"习惯"范畴,本体为"民事习惯",本质为"商事"属性,体现民族性特殊化个性属性,重点突出诸多元素特征。所以,民族商事习惯坚守诚信善良元素的道德底线,习惯本体奠立基础元素特征,民事习惯显现本体元素特征,商事价值突出专业元素特征,重点强调民族性突出特殊元素特征。Ethnic commercial custom is the commercial transaction custom with ethnic particularity, which can change neither its “custom”,nor its nature of commerce, nor its characteristics of traditional elements. Ethnic commercial custom depends on the concept of “custom”,its main body is “civil custom”,and its nature is “com- merce’,？ The concept of ethnic commercial custom embodies the special nature and attribute of nationality, empha-sizing many elemental characteristics. Therefore, ethnic commercial custom insists on the moral bottom line of the element of honesty and kindness, the body of custom sets up the characteristics of its basis element, civil custom embodies the characteristics of its own body element, the commercial value highlights the characteristics of profes-sional element, and the nationality is emphasized with the characteristics of special element.
