明代赵州东晋湖水利纠纷与法律介入——基于《赵州东晋湖志》的考察

摘　　要：随着水利社会史研究的深入,水利纠纷乃至纠纷的解决成为窥探各种社会力量展演的窗口。从法律的视角来看《赵州东晋湖志》中关于明代赵州东晋湖水利纠纷发生、发展及其解决情况,可以看到东晋湖水利纠纷是在当时法律框架下,通过诉讼这一法律途径寻求解决的。大量移民的进入及其引发的社会转变既是以东晋湖为代表的明代云南水利纠纷的根源,也是法律介入纠纷解决过程并不断得以强化的原因。法律介入以及地方对于法律介入的应对从一个侧面展现了明代云南的社会变迁,法律的介入与在地实践、强化,是东晋湖所处的赵州从边疆一个僻远的地方,逐渐转化为"成熟的内地"的推力之一。With the further studies of the history of water conservancy,irrigation disputes and the dispute settlement have become a window to understanding various social forces in history. Based on the interpretation of A History of Zhaozhou Dongjin Lake,this paper expounds the origin,development and settlement of the irrigation disputes over Dongjin Lake in the Ming dynasty,and their solutions by means of litigation under the legal framework. Numerous immigrants and the immigrant-induced social transformation were not only the root cause of Yunnan＇s irrigation disputes in the Ming dynasty,but also the reason for the continuing improvement in the legal settlement. This case shows that the legal intervention and its local response were the driving forces for the transformation of Zhaozhou as a border county into a mature inland county in the Ming dynasty.
