论修改《体育法》的现实紧迫性与可行性

摘　　要：在全面推进依法治国和依法治体的进程中,对颁行于1995年的《体育法》进行修改已提出多年。然而,是不是需要尽快修改和是否已经具备了相应条件,是在分析《体育法》自身不足而应当修改的必要性的同时,还需要从修法的现实紧迫性与可行性方面予以回答的重要问题。为此,该文基于当下中国社会和体育发展的宏观背景,从全面深化改革、迈向体育强国、发展人权事业、建设健康中国、全面依法治国的多个维度,探讨了修改《体育法》面临的迫切需求;并从我国已进入普遍修法时代以及修改《体育法》的社会共识、学术研究和工作基础方面,指出了《体育法》修改所处的良好时机和有利条件。In the process of comprehensively promoting the rule of law and administering the country according to law, Sports Law of the People＇s Republic of China promulgated in 1995 has been revised for many years. However, whether it needs to modify the sports law as soon as possible and whether it is the right time should be decided after analyzing the shortcomings of the sports law and facing the reality. The needs to amend the sports law should be based on the develop- ment of the society and sports, the deepening of reform, from building China into a sports power, ensuring human rights, building healthy China and comprehensively administering the country according to law. China has entered the era of uni- versal law and social consensus, it is the right time for the revision of sports law.
