尘肺病劳工维权困境与对策研究——以N市D企业为例

摘　　要：采用实地调查的方法,旨在探寻尘肺病劳工健康维权的困境,提出解决尘肺病问题的一些策略。通过对D厂尘肺病劳工的研究、调查发现,职业病"诊断难"和尘肺病劳工群体的利益分化是尘肺病劳工维权的困境所在。为维护尘肺病劳工的健康权益,相关部门应加强宣传教育,提高劳工自我保护意识;完善相关制度法规,加强对企业劳动用工管理和生产环境卫生监督;鼓励环保NGO参与到尘肺病劳工的救治工作中;将尘肺病纳入大病保险和城乡医疗救助体系。This article uses the method of field investigation, aims to explore the plight of the health protection of workers with pneumoco- niosis, and puts forward some strategies to solve the problem. Through the research on the pneumoconiosis workers in D factory, the survey found that the occupational disease ＂diagnosis is difficult＂ and the interests of the workers in pneumoconiosis disease differentiation is the plight of the workers＇ rights protection. In order to safeguard the health rights of workers pneumoconiosis,the relevant departments should strengthen publicity and education,improve labor self-protection awareness; improve relevant systems and regulations, strengthen the en- terprise labor management and production environment hygiene supervision; encourage environmental protection NGO to participate in the treatment of the labors with pneumoconiosis ;include the pneumoconiosis disease into Serious illness insurance and urban and rural medi- cal assistance system.
